Australian Citizenship by Descent

Applying for Australian Citizenship by Descent

 

 

Introduction

Australian citizenship by descent may be acquired by a person born outside Australia who is the natural child of an Australian citizen parent.

A person becomes a citizen on the date they are registered as a citizen by the Department of Immigration and Border Protection (DIBP). A certificate of Australian citizenship is issued at the time of registration.

Any person who was born outside Australia on or after 26 January 1949 may make an application to be registered as an Australian citizen by descent if at least one natural parent was an Australian citizen at the time of their birth. Applicants aged 18 years and over must satisfy the Minister that they are of good character.

If the Australian parent acquired Australian citizenship by descent, that parent must have been lawfully present in Australia for a period or periods totalling at least 2 years at some time in their life.

 

Applying online

For residents of Brazil, Argentina, Uruguay and Paraguay wishing to apply online for Australian citizenship by descent, please visit http://www.border.gov.au/immiaccount

If you do not already have one, you will need to first create an ImmiAccount.

When completing the online form, please ensure you select the correct Visa Office. If you select the incorrect office, your application will be transferred to the correct office and this may delay processing.

Please ensure that you prepare all required supporting documents (see checklist below), as well as Form 1195 Identity Declaration before you commence an online application.

If you need to submit further documents during processing of the application, you should do this through your ImmiAccount.

Please ensure that in all cases you submit good quality colour scans of the original documents (not certified or notarised copies).

Applying by Mail

All residents of Brazil, Argentina, Uruguay and Paraguay applying by mail must lodge their application for Australian citizenship by descent at the DIBP office at the Australian Embassy in Brasilia.  Please submit a completed and signed application form (Form 118) and all supporting documentation (see below).

 

Supporting Documentation

The following is a list of requirements to be included with your or your child's application for Australian citizenship by descent. We recommend you submit all required documents in the first instance to ensure timely processing of the application.

All official documents and identity documents submitted by mail must be certified copies, however, in some circumstances we may request you provide original documents.  For online applications, certified copies of documents are not required.  Please ensure that in all cases you submit good quality colour scans of the original documents (not certified or notarised copies). 

Certified copies will be retained. We will return original official documents once we finalise the application, unless you request to have your originals returned to you prior to decision (see below).  See ' return of original documents' (below) for more information about the process to be followed to have documents returned to you.

Any material submitted in a language other than English must be accompanied with an English translation from an official translator.

Document checklist - Applications from Argentina, Uruguay and Paraguay

Certified copies of original documents must be submitted with the application.

These copies must be certified by a Notary Public (Escribano Público o Notario).

Please find below the list of documents required and the correct procedure for submission:

  • Birth certificate of the applicant – you will have to attach a translation into English (traducción pública);
  • Evidence of Australian Citizen parent - Australian birth certificate, Australian passport bio-data page or Australian Citizenship Certificate from one Australian citizen parent – you need to provide certified copies of documents;
  • Proof of applicant’s identity - certified copy of the professional identification card of the person who completed, signed and endorsed the photograph of the applicant – English translation is not required;
  • Evidence of residence in Argentina/Uruguay/Paraguay - such as a photocopy of utility bills (electricity, gas, water, cable TV etc.). Certified copy with English translation is not required

At any time original documents can be requested if the certified copies are not sufficient.

Document checklist - Applications from Brazil

Certified copies of original documents must be submitted with the application.

These copies must be certified by the Notary Public (Cartório de Registro Civil – autenticação de documento)

Please find below the list of documents required and the correct procedure for submission:

  • Birth certificate of the applicant – you will have to attach a certified translation in English (tradução juramentada);
  • Evidence of Australian Citizen parent - Australian birth certificate, Australian passport bio-data page or Australian citizenship Certificate from one Australian citizen parent – you need to provide certified copies of documents;
  • Proof of applicant identity - certified copy of the professional identification card of the person who completed, signed and endorsed the photograph of the applicant – English translation is not required;
  • Evidence of residence in Brazil - such as a photocopy of utility bills (electricity, gas, water, cable TV etc.). Certified copy with English translation is not required.

At any time original documents can be requested if the notarized (certified) copies are not sufficient.

Additional supporting evidence

  • Endorsed passport size photograph - see proof of identity declaration
  • Evidence applicant is a natural (not adopted) child of an Australian Citizen - Certified copy of applicant's birth certificate. Adopted children are not eligible for registration of citizenship by descent - please refer to our child visa options.
  • Evidence that at least one parent was an Australian citizen at the applicant’s birth or became an Australian citizen on 26 January 1949 - Certified copy of parent\'s birth certificate; or Certified copy of certificate of Australian citizenship

    AND

    Evidence that the Australian parent has not taken out another nationality prior to 4 April 2002 - Examples of documents that may be submitted to substantiate your claim include evidence of citizenship held from another country which shows the date that citizenship was acquired.
  • Evidence of change of name, if applicable
  • Evidence of character - If the applicant is over 18 years of age, the applicant must provide penal clearances for their home country and all places of residence outside their home country where they have resided for more than 12 months (cumulatively) in the past 10 years. Applicants who will turn 18 during the application process will be required to provide the relevant police clearances described above.

The charges can be paid at any overseas DIBP office including the Australian Embassy in Buenos Aires or at a DIBP office in Australia.  

 

Return of original documents

The delivery and/or return of original documents (including Australian citizenship extracts/certificates) must be arranged by the applicant/sponsor.

To ensure the speedy and secure delivery of your documents following the processing of an application, please follow the instructions below:

An email will be sent to you to arrange collection or delivery by a courier company.

  • In person: Collection at the Australian Embassy in Brasilia (only) is available by scheduling a collection appointment by return email. This option is not available at the Australian Embassy in Buenos Aires.
  • By courier:  You must prepay and arrange collection by courier with the courier company of your choice from your country of residence.  You are requested to send a return email to the visa office with details of courier arrangement. If you lodged your application online, a copy of the prepaid airway bill (receipt issued by the courier company) should be uploaded to your immiAccount.

Please note that if these instructions are not followed, this will result in a delay in delivering/returning your documents.

 

Passports

The Visa Offices at Australian missions are not responsible for issuing Australian passports to Australian citizens. If you are an Australian citizen and you wish to apply for an Australian passport, please refer to the Services for Australians section on this website.
